🐶 Dirt Dog Terms of Use and Sale
Plain-English summary (the full terms below control): Dirt Dog is a game for entertainment. One purchase covers your household's computers, tablets and phones through the download and the family code; please don't share the code outside your family. We make no promises that the game will teach, improve, or affect your child in any particular way, and screen-time decisions are yours. Digital purchases are final except as described in section 4. The game is provided as-is, and our liability is limited to what you paid.
1. Agreement
These Terms are a contract between you and Mind Right Media about the Dirt Dog game, the free demo, the online version at dirtdogkids.com/play, the website dirtdogkids.com, and related services (together, "Dirt Dog"). By buying, downloading, unlocking, or playing Dirt Dog, or using the website, you agree to these Terms and to our Privacy Policy and Health & Safety notice, which are part of them. You must be an adult (18 or older, or the age of majority where you live) to buy Dirt Dog or agree to these Terms. If you let a child use Dirt Dog, you are responsible for that child's use and for supervising it.
2. What you get: a license
When you buy Dirt Dog we grant you a personal, non-exclusive, non-transferable, revocable license to install and play it on the computers, tablets and phones used by members of your household, through the download, the home Tablet link, and the family code (which unlocks up to six devices; we can reset this for you if you replace devices). Dirt Dog is licensed, not sold; we and our licensors keep all rights, title and interest, including all copyrights, trademarks and other intellectual property. The free demo is licensed on the same basis for evaluation.
You may not: share, publish, sell, rent or give your family code, download link or installer to people outside your household; copy, redistribute, or host the game files; remove notices; reverse engineer, decompile or modify Dirt Dog except as the law allows; bypass or interfere with the purchase check, download limits, device limits or unlock system; or use Dirt Dog for anything unlawful. We may revoke codes and links that are being shared or abused.
Dirt Dog includes the three.js library under the MIT License; that license governs that component.
3. Prices, tax and payment
Prices are shown at checkout in US dollars and may change at any time before you buy. Sales tax or VAT is calculated and added at checkout where required. Payment is processed by Stripe under Stripe's terms; we never see your card details. Promotion codes may be limited in number and time and can be withdrawn. App-store versions, when available, are sold under the store's own terms and prices, and a purchase on one channel does not include the other.
4. Delivery, downloads and refunds
Dirt Dog is delivered digitally, immediately after payment, through the thank-you page, the download email, and the family code. Each purchase allows a generous but limited number of installer downloads and device unlocks so that a leaked link cannot serve the whole internet; contact us if you run out for a genuine reason.
Because the game is delivered instantly and cannot be returned, purchases are final, with these exceptions: (a) if Dirt Dog will not run on a device that meets the requirements on our website and we cannot fix it within a reasonable time after you contact us, we will refund you; (b) if you bought by mistake and have not downloaded or unlocked the game, tell us within 14 days and we will refund you; and (c) any refund the law where you live requires. Refunds go back to the original payment method through Stripe. App-store purchases are refunded by the store under its policy.
5. No educational, medical or developmental claims
Dirt Dog is a video game made for entertainment. Our intent in designing it (no violence, no strangers, no advertising, a built-in break timer, spoken guidance, and kid-sized play about building, caring for things and simple money) reflects our own values as parents, not a claim of results. We do not represent, warrant or promise that Dirt Dog will teach any skill or subject, improve any ability, produce any educational, cognitive, developmental, behavioural, health or emotional outcome, or that it is safer, healthier or better for a child than any other game, activity or the absence of screens. Dirt Dog has not been evaluated, tested or endorsed by any educational, pediatric, medical or psychological authority, and its content has not been rated by the ESRB or any rating board. Nothing on our website, in our social media, or in the game is medical, psychological, educational or parenting advice. Every child is different; what is appropriate for your child, how long they play, and whether they play at all, is a decision for you, ideally with your pediatrician's guidance. Our research note summarises published research for your information only; it is not our claim about Dirt Dog's effects.
The break timer, play-time limit and other parent-mode features are conveniences that a child, or a device, can defeat; they are not a substitute for a grown-up's supervision, and we make no promise about how much or how little a child will play.
6. Health and safety
Please read the Health & Safety notice before a child plays, including the warning about photosensitive seizures, and follow the precautions there. You agree that you are responsible for deciding whether Dirt Dog is suitable for your child and for supervising its use.
7. Disclaimer of warranties
To the fullest extent permitted by law, Dirt Dog, the website and all related services are provided "as is" and "as available", with all faults and without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, or that Dirt Dog will be uninterrupted, error-free, secure, compatible with your devices, or free of harmful components, and without any warranty about educational, developmental, health or other outcomes. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you; in that case any implied warranty is limited to the shortest period the law allows.
8. Limitation of liability
To the fullest extent permitted by law, Mind Right Media and its owners, employees, contractors and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, saves, profits, goodwill or use, arising out of or related to Dirt Dog, the website or these Terms, however caused and under any theory of liability, even if advised of the possibility. Our total liability for all claims relating to Dirt Dog will not exceed the amount you paid us for Dirt Dog in the twelve months before the claim, or ten US dollars if you paid nothing. These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by our negligence where the law forbids such limits, or for fraud.
9. Your responsibilities
You agree to use Dirt Dog lawfully and in line with these Terms, to supervise any child who uses it, to keep your family code and download link within your household, and to compensate us for losses that result from your breach of these Terms or your misuse of Dirt Dog, to the extent the law allows.
10. Third-party services
Stripe (payments), Cloudflare (hosting), Resend (email, when connected), your device's operating system (speech voices), and any app store you buy from are independent services with their own terms and policies. We are not responsible for them.
11. Changes, updates and ending the service
We may update Dirt Dog, add or remove features, and change these Terms. Material changes to the Terms will be posted here with a new effective date; continuing to use Dirt Dog after that means you accept them. We will keep the download and unlock service available for as long as we reasonably can; if we ever have to end it we will give notice on the website, and installed copies keep working. We may suspend or revoke a license, code or link that is being shared or used in breach of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, and by applicable US federal law. If you have a problem, please write to us first; most things can be fixed with an email. Any dispute that cannot be resolved that way will be brought in the state or federal courts located in Florida, and you and we consent to their jurisdiction, except that you may bring a claim in small-claims court where you live, and nothing here takes away consumer protections you are entitled to under the law of your home country or state.
13. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. You may not transfer these Terms; we may transfer them to a successor of the Dirt Dog business. These Terms, the Privacy Policy and the Health & Safety notice are the entire agreement between you and us about Dirt Dog.
